Acceptance of Terms

By accessing and using Picket Ranch (the "Platform"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to comply with these Terms, you may not use the Platform. Picket Ranch reserves the right to modify these Terms at any time. Your continued use of the Platform following the posting of modified Terms will mean you accept and agree to the changes.

These Terms apply to all users of the Platform, including but not limited to: horsewomen and horsemen seeking overnight stabling facilities, facility owners and managers, and any other persons accessing or using the Platform's services or content.

User Accounts

To access certain features of the Platform, you may be required to create a user account. You agree to provide accurate, complete, and current information during the registration process. You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account.

You agree to notify Picket Ranch immediately of any unauthorized use of your account or any other breach of security. Picket Ranch will not be liable for any loss or damage arising from your failure to protect your account credentials or to promptly notify us of unauthorized access.

Users represent and warrant that they are at least 18 years of age or have the legal capacity to enter into binding agreements. You agree not to create accounts or use the Platform for any unlawful purpose or in violation of these Terms.

Facility Listings and Content

Picket Ranch provides access to facility listings, contact information, and related content (collectively, "Facility Information"). While we strive to maintain accurate and up-to-date information, we do not guarantee the accuracy, completeness, or availability of any Facility Information.

Facility Information is provided for informational purposes only. You are solely responsible for independently verifying all information before engaging with any facility. Picket Ranch does not warrant that any facility is suitable for your needs, that facilities maintain specific amenities or conditions, or that contact information remains current.

Users agree to use Facility Information only for lawful, non-commercial purposes. You may not copy, modify, republish, or redistribute Facility Information without prior written consent from Picket Ranch.

User Conduct

You agree that you will not use the Platform to:

• Engage in harassment, abuse, or threatening behavior toward other users or facility operators
• Post false, misleading, or defamatory information about facilities or individuals
• Attempt to gain unauthorized access to the Platform or its systems
• Interfere with or disrupt the integrity or performance of the Platform
• Violate any applicable laws, regulations, or third-party rights
• Engage in any form of commercial solicitation or spam
• Collect or transmit personal information without consent

Picket Ranch reserves the right to investigate and take appropriate legal action against any user who violates these conduct provisions.

Limitation of Liability

To the fullest extent permitted by law, Picket Ranch and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, loss of data, loss of use, or emotional distress, even if advised of the possibility of such damages.

The Platform is provided on an "as is" and "as available" basis. Picket Ranch makes no representations or warranties of any kind, express or implied, regarding the Platform, Facility Information, or related services. To the extent permitted by law, Picket Ranch disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event shall Picket Ranch's total liability to you exceed the amount you have paid to use the Platform in the twelve months preceding your claim, or $100, whichever is greater.

Assumption of Risk

Your use of the Platform and any facilities accessed through the Platform is at your own risk. You acknowledge that horse transportation and overnight stabling arrangements involve inherent risks. You assume all responsibility for evaluating facility safety, suitability, and compliance with applicable regulations.

Picket Ranch is not liable for any injury, death, property damage, or loss arising from your use of any facility or your reliance on Facility Information. You agree to consult with veterinary professionals and other relevant experts before making decisions regarding your horses' care and transportation.

Intellectual Property

All content on the Platform, including text, graphics, logos, images, and software, is the property of Picket Ranch or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes only.

You may not reproduce, modify, distribute, transmit, display, publish, or sell any content from the Platform without prior written permission from Picket Ranch.

Privacy and Data

Your use of the Platform is subject to Picket Ranch's Privacy Policy. By using the Platform, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.

Picket Ranch takes reasonable measures to protect the security of your information; however, no data transmission over the internet is guaranteed to be completely secure. You acknowledge and accept the risks associated with transmitting personal information online.

Termination

Picket Ranch may terminate or suspend your account and access to the Platform at any time, with or without cause, and with or without notice. Upon termination, all rights granted to you will cease immediately.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any legal action or proceeding arising under or relating to these Terms shall be exclusively brought in the federal or state courts located within the jurisdiction specified in your user agreement, and you consent to the personal jurisdiction and venue of such courts.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid, or if such modification is not possible, the provision shall be severed. The remaining provisions of these Terms shall continue in full force and effect.

Entire Agreement

These Terms of Service, together with any other agreements, policies, or guidelines posted on the Platform, constitute the entire agreement between you and Picket Ranch regarding your use of the Platform and supersede all prior negotiations, representations, and agreements.
